Terms of Service

These Terms of Service govern your use of dufaultandlaurentianmaple.ca and the services provided by Dufault & Laurentian Maple. Product purchases are also governed by our Terms of Sale.

1. Language

A French version of these standard-form terms and related policies must be presented and remain available in accordance with Québec’s Charter of the French Language.

A customer may choose to be bound by the English version only after the French version has been provided or made available and the customer has expressly chosen English in accordance with applicable law.

2. Eligibility

You must have the legal capacity to enter into a binding agreement. If you use the website for an organization, you confirm that you are authorized to bind it.

3. Permitted use

You may use the website only for lawful purposes. You must not:

• use it fraudulently or unlawfully;
• interfere with its operation, security or accessibility;
• introduce malware or malicious code;
• scrape or extract content through unauthorized automated means;
• attempt to access systems or accounts without permission; or
• infringe intellectual property, privacy or other legal rights.

4. Accounts

You are responsible for supplying accurate information, protecting your credentials and notifying us promptly of suspected unauthorized activity. We may restrict an account where reasonably necessary to investigate misuse, protect customers or comply with law.

5. Product information

We make reasonable efforts to display products, prices and availability accurately. Colours and appearance may vary because of screen settings, lighting, manufacturing variations or natural materials. Measurements are approximate unless stated otherwise.

Material errors affecting a transaction will be addressed in accordance with Québec law. Nothing in these terms authorizes us to cancel a completed consumer contract solely because of an inventory or advertised-pricing error where such cancellation is prohibited.

6. Intellectual property

The website’s text, graphics, photographs, branding, design and software are owned by or licensed to Dufault & Laurentian Maple and protected by applicable laws.

You may view or print reasonable portions for personal, non-commercial use. No other licence is granted without prior written permission.

7. Reviews and submitted content

When submitting a review, image or other content, you confirm that it is lawful, accurate and non-infringing. You grant us a non-exclusive, worldwide and royalty-free licence to use and display it in connection with our business, subject to applicable privacy law.

We may remove content that is unlawful, abusive, misleading, irrelevant or infringes another person’s rights.

8. Third-party services

The website may use or link to independent third-party services. We do not control their availability, content or practices, except to the extent responsibility cannot legally be excluded.

9. Website availability

We do not guarantee uninterrupted or error-free website access. We may perform maintenance, modify features or temporarily suspend access where reasonably necessary.

10. Liability

Nothing in these terms excludes, restricts or modifies a legal warranty, consumer right or remedy that cannot legally be excluded.

To the extent permitted by law, Dufault & Laurentian Maple is not responsible for indirect or consequential loss that was not reasonably foreseeable. This limitation does not apply to fraud, intentional or gross fault, bodily or moral injury, or liability that cannot lawfully be limited.

11. Governing law

These terms are governed by the laws of Québec and the applicable federal laws of Canada. Mandatory consumer protections in the customer’s place of residence remain unaffected.

12. Changes

We may update these terms prospectively. Changes will not retroactively alter an existing transaction unless required by law or expressly accepted by the customer.
